Articles of Confederation and the US Constitution?
1) Explain what was wrong with the Articles of Confederation?
2) Why did they change it into the United States Constitution?
The articles was a government with the consent of the States. The
National Government could not.
1. raise taxes, they could not operate due to lack of money.
a. Britain occupied several bases in the Northwestern part of the
USA. The national Government could not afford an army to
remove these foreign invaders from our soil.
2. The government could not control interstate trade nor could it control
Foreign Trade.
a. each state levied taxes against out of state trade which KILLED
all of the states trade, farmers went broke because they could not
sell their crops to other states people nor to foreign countries.
b. Spain refused us the use of New Orleans as a shipping port. The
western farmers openly talked about about leaving the USA and
joining Spain.
3. NO EXECUTIVE/PRESIDENT to enforce the Articles powers.
4. NO JUDICIAL/COURT SYSTEM to ensure fair trials for people from
different states.
5. it took 9 of 13 states to pass new laws and 13 0f 13 to amend the
Articles, this never happened.
6. The country had 13 independent states there were no UNITED
STATES.
Shay’s Rebellion, revolt by Western massachusetts farmers proved
that if government was NOT reformed the country would fall apart.
2. Our new FEDERAL GOVERNMENT, shared power between the
National and State governments with the National Government
having the most power, was to be:
a. A 3 branch government:
1. Executive–president. This person enforces the laws. The
government could/would enforce the laws. Check out the
Whiskey Rebellion for an example.
2. Legislative–Congress bicameral/2 house legislature, which
passes laws. They could tax and control interstate/foreign
trade.
3. Judicial—courts. They interpret the laws and ensure fair trials.
b. The idea was that this ne Federal government was responsible
to the people, read the preamble “We the People” and not to
the states for its power, called Popular Sovereignty. The
government was given the power it needed to act for ALL the
people not just for 1 or 2 states. It worked pretty well.
